Positions and Functions

1.    The An Giang Management Board of Economic Zones (hereinafter referred as to Management Board) is an agency of the People's Committee of An Giang province to perform the state management directly to the frontier industrial and economic zones in An Giang province; manage and implement the functions in providing public administrative services and other assistance services related to investment, production, and business activities for investors in the frontier industrial and economic zones in the province as prescribed by law.

2.    Management Board has legal status, account, seal, and office in An Giang province; being a budget planning agency of An Giang Province; being separately balanced capital for development and investment from the central budget; funding for state administrative and professional activities of the Management Board as funded by the State and as prescribed by law.

Missions and authorities

1.    Participating in providing feedback, developing, and presenting to the Ministries, Departments, and the Provincial People's Committee for approval and implementation of the following tasks:

a.    Participating in providing feedback, developing, and presenting to the Ministries, Departments, and the Provincial People's Committee  in the development of legal documents, policies, and plans related to the activities in investment and development of industrial and economic zones;

b.    Monitoring and coordinating with relevant agencies to develop coordinative work regulations with the specialised agencies of the Provincial People's Committee or the relevant agencies to perform the duties and authorities as assigned according to the OSS and OSS, presenting to the Provincial People's Committee for approval and implementation;

c.    Developing programs and plans to promote investment in the development of industrial and economic zones and present to the Provincial People's Committee for approval and implementation;

d.    Developing annual and 5-year plans on developing human resources to meet the needs of industrial and economic zones and presenting to the Provincial People's Committee for approval and implementation,

e.    Budgeting the professional expenditure and annual investment capital for the development of the Management Board and submitting to the competent authority for approval under the provisions of the Budget Act and related legislation.

2.    The Management Board shall comply with the provisions of the law and follow the instructions or authorisation of the Ministries and the Provincial People's Committees of the following tasks:

a.    Management, dissemination, guidance, inspection, monitoring, inspection, and penalisation on administrative sanctions in implementing regulations and plans approved by the competent authorities related to industrial and economic zones;

b.    Registration for investment; verification and issuance, amendment, revocation of certificates for investment projects under the jurisdiction;

c.    Granting, amending, modifying, and extending permits for establishing representative offices of foreign commercial organisations and traders located in industrial and economic zones; granting business licenses for the trading activities and other related activities for enterprises with overseas investment capital and foreign investors investing for the first time in industrial and economic zones upon written approval of the Ministry of Industry and Trade;

d.    Adjusting the approved construction plans of industrial zones and the functional areas within the economic zones without changing the functions of land use and planning structure; evaluating the basic design for the project of groups B, C or granting, renewing construction permits for construction works that require permits as prescribed by law on the management of investment projects of construction work; granting ownership certificates for construction works in industrial and economic zones for the involved organisations;

e.    Granting, re-granting, renewing, and revoking work permits for foreigners and the Vietnamese residing abroad to work in industrial and economic zones; issuing labour record books for Vietnamese labourers working in industrial and economic zones; organising registration of labour regulations, collective bargaining agreements, occupational safety rules, wage scales, payrolls, labour norms, plans for sending labourers abroad for internship under 90 business days; receiving reports on the agreement, utilising and terminating labour contracts of the enterprises;

f.    Granting certificates of origin of goods produced in the industrial and economic zones and other relevant licenses and certificates in industrial and economic zones;

g.    Confirming contracts and documents on real estate in industrial and economic zones for the involved organisations;

h.    Organising evaluation and approval of reports on environmental impact assessment for projects under the jurisdiction of the Provincial People's Committee in industrial and economic zones;

i.    Inspecting, monitoring the implementation of the investment objectives specified in the certificate of investment, progress of capital contribution and implementation of investment projects; monitoring and coordinating to inspect the implementation of commitments for the projects with incentive investment and the observance of the law on construction, labour, wages, social insurance with employees; protecting the legitimate benefits of employees and employers, the activities of socio-political organisations, fire prevention, security, and environment protection in industrial and economic zones; making decisions on penalisation of administrative violations as prescribed by law under their jurisdiction and proposing to State management organisations to handle violations beyond the jurisdiction;

j.    Handling problems and concerns of investors in industrial and economic zones and recommendations to the Prime Minister, the involved Ministries and the Provincial People's Committee to resolve these issues if beyond the competence;

k.    Receiving statistical reports and financial statements of companies operating in industrial and economic zones; evaluating the effectiveness of investment in industrial and economic zones;

l.    Coordinating with the Ministry of Planning and Investment in the development and management of information system in industrial and economic zones under the jurisdiction;

m.    Making periodic reports to the Ministry of Planning and Investment, other involved Ministries and the Provincial People's Committee on the following situations: the construction and development of industrial and economic zones; granting, modifying and revoking investment certificates; deploying and operating investment projects; performing their obligations to the state; attracting and utilising employees; implementing the provisions of the labour law and handling labour disputes as well as implementing measures to protect the ecological environment in industrial and economic zones;

n.    Organising movements and rewarding enterprises in industrial and economic zones;

o.    Organising and coordinating with the State management agencies to inspect, examine, and resolve complaints and denunciations, prevention of corruption, waste, negatives and penalising administrative violations in the area;

p.    Performing the duties as prescribed by law and the provisions of the Provincial People's Committee in financial management, allocated properties and budget; collecting and managing the use of fees and charges; conducting scientific research and application of science and technology; cooperating with other national and international organisations and individuals in the fields related to the construction and development of industrial and economic zones; managing the organisations, payroll, personnel, public servants and the training and retraining of professional service staff, public servants and employees of the Management Board; introducing employment opportunities for workers working in industrial and economic zones;

q.    Performing other duties assigned by the Provincial People's Committee

3.    Developing and presenting to the Provincial People's Committee in order to submit to the Prime Minister for decisions under the authority:

a.    Plans on construction of economic zones

b.    Plans on issuance of infrastructure bonds; plans for raising capital from other sources to invest in developing systems for important technical and social infrastructure in the economic zones.

4.    Developing and presenting to the Ministries, Departments, and the Provincial People's Committee for approval and implementation of:

a.    Detailed plans on the construction of functional areas in accordance with the approved plans in building economic zones, detailed plans and land use plans in the economic zones to submit to the Provincial People's Committee for approval;

b.    Annual plan and 5-year plans on economic zones to present to the Provincial People's Committee and the other authorities for approval;

c.    The list of annual and 5-year investment projects and investment plans for development to present to competent authorities for approval or self-approved under jurisdiction;

d.    Developing frames for rates, fees, and other charges applied in economic zones to present to the competent issuance authorities as prescribed by law.

5.    Management Board of Economic Zones shall direct or organise the implementation of the following tasks:

a.    Complying in accordance with the law and as directed or authorised by the Ministries, Departments, and the Provincial People's Committee including the issuance, amendment, revocation of business registration certificate as prescribed by law for enterprises for the establishment of economic organisations in the economic zones; granting, re-granting, elaborating, modifying, and extending permits on establishment of representative offices, branches in economic zones for foreign tourism enterprises ;

b.    Hiring foreign consultant agencies for advice on investment promotion, strategies on the construction and development of economic zones;

c.    Deciding on investment for the project groups B, C and utilising state budget to invest in the economic zones under the authorisation of the Provincial People's Committee;

d.    Signing the BOT, BTO, and BT contracts for projects group B, C, under the authorisation of the Provincial People's Committee; directly receiving, managing, and utilising ODA capital;

e.    Managing and utilising investment capital for the development of economic zones under the jurisdiction; managing investment, construction, bidding for investment projects with development budget from the state in the economic zones under their jurisdiction; managing and implementing the administrative revenue and expenditure, goals of programs, and other sources as assigned in accordance with the law;

f.    Monitoring and coordinating with relevant agencies to carry out the maintenance of buildings and technical-social infrastructure and public service projects invested from the state budget in the economic zones;

g.    Effectively managing and utilising land and water surface allocated in accordance with usage purposes and in accordance with the general plans on constructing economic zones, detailed plans on constructing functional areas, land use plans approved by the competent authorities;

h.    Re-allocating the fees of land use, free land re-allocation, and lease of land, water surface, and implementation of land management in the economic zones as prescribed by the Land Law;

i.    Based on the regulations of the Provincial People's Committee and the law on investment and land, deciding to use the collection of rents and the rate for exemption and reduction of land and water used for each investment project in cases of land re-allocation and lease without auction or bidding for land use rights;

j.    Coordinating with local authorities and relevant agencies to ensure that all activities in economic zones are relevant to the plans on construction and development of economic zones as approved by the relevant authorities and regulations.
